Important Notice
If the business owner satisfies all outstanding sales tax obligations prior to the auction, the auction will be canceled, and all registered bidders will be notified.
NO WARRANTY & AS-IS SALE
All property is sold "AS IS" and ALL SALES ARE FINAL.
- LOADING & HANDLING HEAVY ITEMS WILL BE THE RESPONSIBILITY OF THE BUYER.
- It is the Bidder's sole responsibility to determine the condition, age, authenticity, value, or any other factors related to the items.
- Nutt Auction shall endeavor to describe each item accurately, but will not be held responsible for errors, omissions, or the accuracy of descriptions.
- Any statements made by the Auctioneer are opinions only and do not constitute a warranty or representation.
- Nutt Auction reserves the right to withdraw, re-catalog, or reclassify any item prior to or during the auction.
- Any announcement made after the publication of printed material or during the sale takes precedence.

- NO WARRANTY, EXPRESS OR IMPLIED, is made with respect to any item or description in this auction.
- Nutt Auction expressly disclaims all warranties, including merchantability and fitness for a particular purpose.
- Descriptions are provided solely for identification purposes for those bidders who are unable to view items in person and are not part of the basis of the bargain.
General Terms
- These terms constitute a legally binding contract between you (the Bidder) and Nutt Auction Company.
- To register and bid, you must agree to all terms and conditions.
- Special terms for individual auctions will be clearly stated at the beginning of the catalog if applicable.
- All items are considered used or previously owned, even if labeled “new in box.” Retail condition is not guaranteed.
- Once a bid is placed and confirmed, it cannot be removed or lowered.
- Bidders are responsible for performing their own due diligence before bidding.
- Nutt Auction is not responsible for accidents, theft, errors, or omissions.
- Auctioneer may combine or split lots, change minimum bids or reserves, or cancel/postpone the auction or any item.
- Items shown in photos such as crates, totes, or display props are not included unless specified.
Invoices & Payment Terms
- Invoices under $1,000 will be charged in full to your card.
- Invoices over $1,000 will have a 10% non-refundable deposit charged to your card, with the remaining balance due by cash or wire transfer by the next business day.
Payment Methods Accepted
- Credit Cards: Accepted for invoices under $1,000 and for deposits.
- Cash & Wire Transfers: Required for remaining balances on invoices over $1,000.
Buyer’s Premium
- A 15% Buyer’s Premium applies to all winning bids.
Credit Card Terms and Authorization
By registering and placing bids, the buyer agrees:
- To authorize Nutt Auction to charge the card on file according to the payment terms.
- NOT to initiate chargebacks, disputes, or payment reversals under any circumstances.
- That all sales are final and all items are sold AS IS, with no guarantee or warranty.
Any dispute of valid charges will be treated as a breach of contract and may result in legal action.
Auction Closing & Bidding Process
- Auction closing times are posted in the auction info.
- Bidding uses a MAXIMUM BID system; your bid will only increase as needed to keep you in the lead.
- In the event of a tie, the first bidder at that amount wins.
- You will be notified via email if you are outbid.
- We strongly recommend using the max bid feature early, especially if you’re unavailable during auction closing.
- Nutt Auction is not responsible for technical difficulties or internet failures that prevent last-minute bids.
Load Out & Pickup Requirements
- All items must be picked up by 3:00 PM, Tuesday, May 15, 2025.
- Buyers must check in with a Nutt Auction staff member upon arrival.
- Staff will help identify your items but WILL NOT assist with lifting, loading, or handling heavy items.
- Pickup must be completed during scheduled time.
- Buyers must bring their own labor, tools, and packing materials.
- If buyers miss the scheduled time or leave items behind, those items will be forfeited and may incur additional removal or disposal fees.
- Buyers are responsible for any damage to the item or property during removal.
- Nutt Auction reserves the right to deny pickup if removal poses a safety or property risk.
- Address for pickup will be available on the email with paid invoice.
