GUN PURCHASING RULES

Handguns:

To purchase and carry a handgun, an Arkansas resident must meet the following criteria:

• I have lived in Arkansas for the past six months.

• I am 21 years of age or older.

• I have not been convicted of a felony.

• I have not been charged with a misdemeanor of Class A or B.

• I am not intoxicated.

• I do not owe back taxes or child support.

• I have not been convicted of any domestic violence misdemeanor.

• I am not subject to certain court orders related to domestic violence.

Long Guns:

• I am 18 years of age or older.

• It is legal to own a long gun in my state of residence.

• I have not been convicted of a felony.

• I have not been charged with a misdemeanor of Class A or B.

• I am not intoxicated.

• I do not owe back taxes or child support.

• I have not been convicted of any domestic violence misdemeanor.

• I am not subject to certain court orders related to domestic violence.

Driver’s License will be verified at pickup.

AUCTION TERMS AND CONDITIONS

These Bidder Terms and Conditions apply to auctions conducted by NUTT AUCTION COMPANY, LLC (“Auctioneer”) and constitute a legal, valid, binding, and enforceable contract between Auctioneer and YOU. Together with any written purchase and sale agreement between YOU and the Seller of any Lot, these Bidder Terms and Conditions form the basis for the contract of sale between YOU and the Seller if YOU are the Winning Bidder on any Lot.

BUYER’S PREMIUM

• Buyer's Premium: 15% Buyer’s Premium.

• Buyer's Premium is calculated as a percentage of the Hammer Price and is added to the final Contract Price.

AUCTION CONDUCT

The Auction is conducted under and in accordance with these Bidder Terms and Conditions, any additional terms posted by Auctioneer, and any announcements made at the time of the Auction.

Auctioneer and Staff Bidding Rights
Auctioneer and staff reserve the right to bid on items being sold.

Item Ownership Upon Payment
Items are not deemed sold until the buyer has paid for the item in full.

RESERVE AUCTION

Unless specifically stated otherwise, all Lots are exposed for sale WITH RESERVE. This means that property may be withdrawn, and bids may be rejected by Auctioneer prior to the Fall of the Hammer.

BIDDER REGISTRATION AND QUALIFICATION

• YOU must register to bid and provide a valid credit card for approval.

• Auctioneer may refuse any Bidder Registration or revoke bidding privileges at any time.

• Bidders must be at least 18 years of age and legally able to enter a contract.

ONLINE BIDDING & TECHNOLOGY DISCLAIMERS

• Auctioneer is not responsible for disruptions, errors, or failures in online bidding platforms.

• Auctioneer may, at their discretion, extend or reopen bidding in case of technical issues.

INSPECTION & ALL SALES FINAL

• All Lots are sold AS IS, WHERE IS, WITH ALL FAULTS.

• No warranties, guarantees, or refunds are offered.

• Buyer assumes responsibility for inspecting Lots prior to bidding.

ITEM PICKUP & REMOVAL

• Buyer is responsible for the removal of purchased items.

• If items are not picked up within the designated timeframe, they may be deemed abandoned.

• A storage charge of $5 per Lot per day will apply to uncollected items.

FAILURE TO PAY

• If YOU fail to pay, the Lot(s) may be resold, and YOU will be responsible for any deficiency or shortfall.

• Auctioneer may take legal action to collect unpaid balances.

NO STOP PAYMENTS OR CHARGEBACKS

• YOU may not issue a stop payment order on checks or initiate chargebacks on credit card transactions.

LIMITATION OF LIABILITY

• Auctioneer is not responsible for actions of Sellers or Bidders before, during, or after the Auction.

• Auctioneer makes no guarantees regarding descriptions, condition, or fitness of any Lot.

GOVERNING LAW

• These terms are governed by the laws of Texas.

• Any disputes must be resolved in Bowie County, Texas.

• YOU waive the right to a jury trial.

ACCEPTANCE OF TERMS

By registering and participating in the Auction, YOU acknowledge and agree to abide by these Terms and Conditions.
